Today’s LiveWire Spotlight evaluates NERC’s re-submission to FERC, which looks to modify the Rules to establish a “Consolidated Hearing Process” that Regional Entities may use in lieu of their own. The ERO expects more consistent outcomes will result when a Registered Entity contests a finding of noncompliance, mitigation plans, remedial action directives, penalties, or sanctions.
NERC’s modified petition to the Rules of Procedure have been submitted to FERC. Once approved, Regional Entities will be given the option to conduct their own compliance and enforcement appeals proceedings or to utilize the new Consolidated Hearing Process.
